Promising Health Care Reform

Life of the community care services and support to the Act (Class Act) is a recent nationwide program that seeks to restore the interest of millions of Americans to finance their own care, despite the increased cost and inefficiency of Medicaid in financing long-term care. This program provides an opportunity for people who are functionally disabled and require a community living assistance and support to afford long-term care insurance by providing a very low amount of premium. The effective date will be January 1, 2011 but payment for benefits will not happen before 2017. Department of Health and Human Services (HHS) is responsible for the program and will issue any guidelines on benefits and registration.

Who can join?
Residents of more than 18 years and earns income can participate in the program Class Act. Employees are automatically enrolled, but they reserve the right to reject their participation in the program. Self-employed individuals may enroll in the program using an alternative method that will be created HHS. However, employers are not obliged to offer a class act program or receive any money from their employers. Qualifying for the CLASS Act is much easier than any private insurance, because it does not require strict underwriting. Thus, any pre-existing condition does not prevent the individual from registering in the program.

Who is eligible for benefits?
Adults with multiple functional disabilities or related disorders (as defined by HHS) will be entitled to receive benefits after they have paid monthly premiums for at least five years. Persons who are not able to make everyday activities or cognitive impairment that persists for more than 90 days are also eligible for benefits. Daily activities or ADL were bathing, dressing, moving, eating, and toilet.
